Traveler’s Responsibilities

Please provide the details of your air travel as soon as you have confirmed it with the airline. TravelSmiths must receive the details of your itinerary at least eight (8) weeks prior to departure. Failure to provide this information will result in airport transfer fees being non-refundable.

It is the traveler’s responsibility to review all travel documents for accuracy. Information such as the traveler’s full, legal name, and date of birth must match the information on the traveler’s passport. If you find a discrepancy, please notify your travel consultant immediately.

Passports must be valid for at least six months after the traveler’s scheduled return date. It may take several weeks to months for passport renewals to be processed by the U.S. State Department, so please ensure your passport will be valid for the required length of time. Visit travel.state.gov for more information regarding passport requirements.

It is your responsibility to fulfill the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

It is the traveler’s responsibility to provide TravelSmiths Inc. with a copy of the information page of his or per passport book. Everyone, including children and infants, must have a valid Passport to travel internationally. A “passport card” is not valid for international air travel.

We ask for a copy of your passport to ensure a few things. 1. To ensure the name on your passport matches your travel documents. 2. To confirm that your passport will not expire within 6 months of the return date of your trip. 3. To assist your return into the U.S. if you were to lose your passport while abroad.

If you are not comfortable giving us your passport, we ask that you send us a written statement confirming that someone in your home country will have a copy of your passport. The person with the copy of your passport will be reachable during your travel and assist you if needed.

If you do not provide copies of your passports, you will be responsible if there are any name discrepancies.

Final payment, cancellation, and revision

Final payment is due by December 1, 2023, and is 100% non-refundable after this date.

TravelSmiths Revision and Cancellation Policy

Revision:

● If you request any changes to your booking after the initial deposit, TravelSmiths charges a revision fee of $75.00 per booking, per instance.

Cancellation:

● After initial deposit: The per-person deposit, in addition to supplier’s air/land/cruise penalties.

● After final payment: 15% penalty of the total package cost, in addition to supplier penalties.

● Most travel insurance companies cover cancellation penalties for covered medical reasons.

● TravelSmiths must receive cancellation notice in writing.

● If clients are late in making final payment, TravelSmiths may, within its sole discretion, consider this client canceled and retain any or all payments made.

● Any fees charged by our travel partners are subject to the terms and conditions of their own contracts. TravelSmiths is not responsible for outside partnership penalties.

Travel Insurance

Travel documents will not be processed without the purchase of travel Insurance or a statement of denial of the offered travel Insurance. Travel insurance is non-refundable.

We believe travel insurance is an excellent way to protect the investment you’ve made in your upcoming trip. As a service to our valued clients, TravelSmiths offers comprehensive travel insurance policies. Specific travel insurance coverage questions must be directed to the respective insurance company, as we at TravelSmiths, Inc. are not insurance agents.

Worldwide Trip Protector Prime Comprehensive travel insurance rate is based on the traveler’s age and total price of travel per person. For pre-existing conditions to be waived, this insurance must be booked within 14 days of your initial deposit. You may purchase this insurance outside of 14 days of deposit, but it will not cover pre-existing conditions. Travel insurance may be purchased up to 48 hours before your departure.

Our Agreement With You

This booking receipt and these terms and conditions will only be sent to the name (addressee) listed on this notice. Therefore, it is the sole responsibility of the addressee to inform all other parties traveling of the contents of these terms and conditions. By making payment to TravelSmiths Inc. and accepting this receipt, you acknowledge that you have been advised of, reviewed, and hereby accept these terms and conditions for travel related services.

We sell a variety of travel related products from different suppliers and service providers ("Suppliers"). Each Supplier has its own terms and conditions that are applicable to your particular arrangements, which are separate and in addition to TravelSmiths Inc.’ general terms and conditions.

TravelSmiths Inc. is acting as an intermediary or a "Booking Advisor" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

Federal law forbids the carriage of hazardous materials aboard the aircraft in your luggage or on your person. A violation can result in five years imprisonment and penalties of $250,000 or more (49 U.S.C.5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.

There are exceptions for small quantities (up to 3 ounces per container) of medicinal and toiletry articles carried in your luggage and certain smoking materials carried on your person. For further information contact your airline representative.

Travel Advice and Vaccinations

U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at www.travel.state.gov for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

S.T.E.P. Smart Traveler Enrollment Program

Please register your trip on S.T.E.P - when traveling out of the country, you can log your trip and where you will be during your stay. This will alert the closest US Embassy that a US traveler will be at this resort during this time. In case of terrorism, weather-related incidents or any emergency situation, they will be able to locate you and also alert your emergency contact that you are okay and safe, especially in loss of power scenarios. Bedding and Room Requests

Please be advised that all room bedding requests are based on AVAILABILITY at the time of check-in and are NOT GUARANTEED. Only bedding requests that are guaranteed are those room categories that specify the bedding in the name of the room category when purchased. (IE. Deluxe Double Bed Room OR Deluxe King Bed Room). Connecting rooms are not guaranteed, they are based on AVAILABILITY at the time of check-in. Check-in can vary from 3:00-4:00pm at most Resorts Some properties offer guaranteed connecting rooms for an additional charge. Please inquiry with your TravelSmiths Inc. Groups Consultant if this is a requirement for your booking.

General Travel Information

Rates are based on US dollars and are only valid for citizens of the United States. Prior notification of any NON-US Citizen traveling with group will be required and may be subject to increased rates. No room changes will be accepted less than four (4) weeks prior to departure. Any changes requested after this point may be subject to additional fees.

Travel Documents and Destinations

It is your responsibility to ensure that all the details on your travel documents are correct and to bring to our attention immediately any errors or discrepancies. Prior to booking International travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any destination, we do not represent that travel in such destination is safe or without risk.

If you are a citizen of a country other than the United States, you are solely responsible for fulfilling all requirements to enter your International destination. Electronic documents will be provided unless otherwise noted. The tour operator charges $25.00 per person if you wish to have separate paper documents. Once documents are issued, there will be a $50.00 penalty per change and any penalties or additional collection by the carrier or hotel. Documents are issued at the time of Final Payment.

VERY IMPORTANT: Please be advised, if you were born in Jersey City or Hudson County, you must check with the NJ Bureau of Vital Statistics at (800) 669-8309 to verify that you have a VALID birth certificate with a raised seal from the state of New Jersey.

Additional Documentation

If you’re traveling with a minor and one/neither of their parents are with you, prepare to be asked to provide documentation that you have permission to travel with the minor. Ask the minor’s parents to sign a “Travel Consent Form,” available free on many legal websites, and have it signed in the company of witnesses. Take the form along with you and have it handy when you are traveling.

Carry required travel identification for your specific itinerary.

Check the expiration date of everyone’s passport. Passports for individuals under the age of 16 usually expire after five years and for those age 16 and over after ten years. Release and Waiver of Liability Agreement

WHEREAS, TravelSmiths, Inc. (“Company”) is the travel agency assisting with the travel arrangements for a group trip to Punta Cana from March 9 through March 13, 2024 (the “Group Trip”). The applicable properties include Breathless Punta Cana and Dreams Onyx and are hereinafter referred to collectively as (the “Premises”). For good and valuable consideration, including but not limited to being provided access to the Premises,

I hereby stipulate and agree:

1. Assumption of Risk. I acknowledge and understand that my attendance on the Premises will not be supervised by the Company and that the Company does not provide medical services. I acknowledge that I have reviewed and approved my room assignment. I understand that the Premises serves alcohol to individuals who are of the legal drinking age. I understand that Breathless Punta Cana is an adult only resort and minor children are not permitted access. I acknowledge that the Premises include multiple facilities and certain voluntary excursions which may present a dangerous activity. I understand that even if the Company has taken any proactive measures to reduce potential exposure, dangers, and/or injury there is still high risk of exposure, dangers, and/or injury and the Company has not in any way represented that there is no exposure, dangers, and/or injury risk due to their proactive measures. I VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO MY PARTICIPATION IN THE GROUP TRIP OR USE OF THE PREMISES, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF CAUSED BY NEGLIGENCE OF THE COMPANY.

2. Release from Liability. I hereby agree to fully and forever discharge and release Company from any and all claims I may have or hereinafter have for any injury, temporary or permanent disability, death, damages, liabilities, expenses and/or causes of action, now known or hereinafter known in any jurisdiction in the world, attributable or relating in any manner to my participation in the Group Trip and presence on the Premises. I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND UNDERSTAND EACH OF THE ABOVE PROVISIONS AND THAT I UNDERSTAND I AM GIVING UP SIGNIFICANT LEGAL RIGHTS ON MY BEHALF. I AM 18 OR OLDER, I AM COMPETENT AND I SUMBIT THIS AGREEMENT VOLUNTARILY AND FOR ADEQUATE CONSIDERATION INTENDING TO BE FULLY BOUND.
